Jackson council plans legal action against developers

JACKSON – The Township Council has authorized the municipal attorney to file legal action against several developers and insurance companies which will allege those entities did not live up to their responsibilities.

In separate actions at its May 9 meeting, the council:

• Authorized the township attorney to file suit against Farmingdale Woods LLC, Gulf Insurance Company and the Travelers Indemnity Company. A resolution states that the township and its outside engineer, T&M Associates, “have determined that numerous items remain to be completed” in regard to the site plan and the subdivision inspection report.

The council declared Farmingdale Woods LLC to be in default of items covered in the maintenance bond. The legal action will seek the immediate completion of the remaining punch list items.

• Authorized the township attorney to file suit against R. Stone and Company/Windsor Crescent and NGM Insurance Company. A resolution states that Jackson and its outside engineer, T&M Associates, “have determined that numerous items remain to be completed” in regard to the site plan and the subdivision inspection report.

The council declared R. Stone and Company/Windsor Crescent to be in default of items covered in the maintenance bond. The legal action will seek the immediate completion of the remaining punch list items.

• Authorized the township attorney to file suit against Zaidi Homes Inc., Albert Lee Construction Inc., The Insurance Company of the State of Pennsylvania and First Indemnity of America Insurance Company. The legal action concerns the Melody Woods development. A resolution states that the township and its outside engineer, T&M Associates, “have determined that numerous items remain to be completed” in regard to the site plan and the subdivision inspection report.

The council declared Zaidi Homes Inc./Albert Lee Construction Inc. to be in default of items covered in the performance bond. The legal action will seek the immediate completion of the remaining punch list items.

• Authorized the township attorney to file suit against Jackson Square Center LLC, which is a commercial location, and First Indemnity of America Insurance Company. A resolution states that Jackson and its outside engineer, T&M Associates, “have determined that numerous items remain to be completed” in regard to the site plan and the subdivision inspection report.

The council declared Jackson Square Center LLC to be in default of items covered in the maintenance bond. The legal action will seek the immediate completion of the remaining punch list items.
