Howell municipal court judge dismisses resident’s noise complaint

HOWELL – A municipal court judge has dismissed a complaint filed by a resident of Castle Court who has been dealing with noise emanating from a movie theater near his home for almost two years.

Howell Municipal Court Judge Susan Schroeder Clark dismissed the complaint in court on May 11, resident Marc Parisi said.

“The judge dismissed the complaints because Abe Tress is not the property owner, although he is a property manager. When I filed complaints in August 2017, I filed them against the (Xscape Theatres Howell 14) and the (Greenleaf at Howell) shopping plaza, but the judge only signed one complaint against that individual in December. It is so crooked,” Parisi said.

“When I originally filed complaints against Sun Equity Partners and Xscape Theatres Howell 14 on Aug. 29, 2017, the court clerk told me I had to name individuals, so I named Abe Tress, who was the property manager, and Chance Ragains, who was the owner of theater.

“It turns out this was not true. Complaints can be issued against corporations and not name an individual. It is so crazy how everyone in this town is trying to do all they can to thwart my efforts for (code) enforcement and justice,” Parisi said.

Parisi said he has a motion hearing scheduled for 9 a.m. May 25 before state Superior Court Judge Linda Grasso Jones, sitting in Freehold.

Parisi has said for several years that noise coming from movies being shown at the Xscape Theatres Howell 14 on Route 9 north near Lanes Mill Road is audible at his home. The issue has been the subject of Zoning Board of Adjustment hearings and a municipal ordinance.
