Developer will seek approval for homes in Marlboro commercial zone

MARLBORO – An application that will propose the construction of single-family homes and townhouses in a commercial zone on Buckley Road is scheduled to be heard by the Marlboro Zoning Board of Adjustment on Sept. 4.

The application was initially scheduled for a hearing before the board on Aug. 14. With only four board members present, the panel would not have been able to vote to grant a use variance, which requires five affirmative votes.

Attorney Salvatore Alfieri represents the applicant, Buckdale LLC, and consented to move the hearing date to Sept. 4.

The application consists of four lots that create an 11.3-acre parcel with frontage on Buckley Road, School Road East, Route 79 and Route 18. Information provided by the township indicates Route 18, a state highway, runs through the property.

At present, the site contains two dwellings and accessory buildings, with access from Route 79 and Buckley Road.

Buckdale will seek a use variance from the zoning board that would permit the removal of all the existing site improvements and allow residential uses in a commercial zone.

The applicant seeks to construct a development consisting of 26 single-family residential lots and 19 townhouse lots. Nine townhouses would be designated as affordable housing. All the other homes would be market rate units, according to the application.

Access to the development is proposed from Buckley Road. No access to the development is proposed from School Road East, Route 18 or Route 79.

Residential development is not a permitted use, an accessory use or a conditional use in a commercial zone, which is why a use variance is required. If use variance approval is granted, Buckdale may be required to return before the zoning board for any subdivision and/or site plan application and approval, according to information provided by the zoning board.
