MILLSTONE – The Township Committee has declined to accept a conservation easement at the location of a planned self-storage facility on Route 537, Millstone Township.
On March 6, committee members passed a resolution rejecting the dedication of the conservation easement at the location of Central Jersey Storage, LLC’s, planned business.
Central Jersey Storage’s plan to construct one two-story building and five one-story buildings received approval from the Zoning Board of Adjustment in 2017.
Construction of the self-storage operation has not begun, according to municipal officials.
As part of the project’s final site plan approval, a conservation easement was dedicated to Millstone and recorded by Monmouth County in 2018, according to the resolution. The easement was intended to be consistent with a New Jersey Department of Environmental Protection (DEP) wetlands buffer delineation.
However, municipal officials declined to accept the conservation easement because it was determined the metes and bounds (boundaries) description for the easement was slightly inconsistent with the easement required by the DEP, according to the resolution.
The conservation easement cannot be accepted by the township until a written resolution of acceptance has been passed.
Officials said a new conservation easement containing the correct metes and bounds description will need to be recorded. The revised deed and the correct metes and bounds description, along with an agreement declining the acceptance of the original easement, will be recorded in the Monmouth County Clerk’s office.
The committee’s action declining acceptance of the original easement was made with the condition that a fully executed revised conservation easement approved by the township engineer is delivered to the township attorney’s office in a form acceptable for recording, according to the resolution.
